Hi. I am VERY new to this and I've been buying content like crazy, mostly poses and presets like cum, anal shapes, props...etc. I'm using them to make a short 3d comic book and if it is popular I'd like to make more and put them up for sale. The question is: is this legal? I do NOT want to disrespect the artists or fuck anyone over, but I REALLY don't want to stand in front of a judge and explain why I illegally used other's content in a porn comic and why I shouldn't have to pay a huge fine and not go to jail! 


So...to be clear...I am creating my own images with characters I created fresh in Daz4, but I am using preset poses, scenery and cum splashes I have purchased from other artists to create a comic book. Am I going to go to jail if I sell it? Will I piss off the artists if I publish it?

As for art you create with purchased products, it is fine to sell your created images. The problem arises if you redistribute the files you have purchased. That is when you traverse to the legal fights, and really pissed off vendors. To be sure contact the vendors and ask. For most products it is expected to be used for commercial comics as well as personal use. From what I've gathered you have to check the readme, TOS, for permissions. Esp if you are using freebies, or celeb licensed content. Rules are usually written there, but as a safe guard, contact the vendor. They usually are ok with art created being sold. I am ok with it as long as my work, the files, aren't being redistrubed. I welcome my products being used for people's comics.

Thank you for replying. From the license info I've seen on the DAZ4 Website it seems like a render is okay to distribute...actual files are not and interactive games are a no-no as well. I think it is a very good idea to ...as you say....check with the artist for an okay before publishing. :)

1.) Don't expect accurate legal advice from a web forum
2.) Every country has different copyright laws, look up what your laws are or find a copyright lawyer to ask.

Every product you buy should come with a license along with a Read Me file.  Read them and take nothing for granted.


Usually in the comic business, Most props are sold and given the right for commercial use.  If you use freebies then you should ask permission of the vendor. Best to save any corespondence in that regard. and at the back of your stories create a disclaimer page, and thank the vendors who gave you the products to work with.  Do not have to go name by name but just do an overall thank you, but for the freebies give them a shout by name


There has been talk about having to buy a 2nd license for animation creation as some of these figures have the ability to appear in an video game and the original license may not pertain that medium.


As mention, so not share your products or resell them,  THAT WILL get you in hot water.. That license was intended for you and you only.and yes every country has their own rules in regards to production of comic art and what is taboo.and if you post here, get in touch with store management and be ready to have samples.


If you are thinking about comics Might I suggest Plasq's Comic Life   It's awesome comic software and cheap


Don't be afraid to ask questions in the forums as that is the way you learn and comic artists have increased tenfold since I came on board

My basic legal understanding is that when you purchase an item from DAZ, a character, clothing items, props or hair etc. [basically any 3D digital model with associated materials, textures, shaders and rigging] you aren't actually purchasing the model but a license to use that model to produce 3d art, animations and still frame renders. For some products at DAZ you can purchase an additional Interactive license usually for an extra $50 or so. This allows you to use the model in a game which you sell on. But not all sellers permit such use and they don't sell an additional add on interactive license


Also usually unless you have an interactive license they don't like you to export to another program and remodel but Hexagon transfers back and force are probably okay to do custom morphs.


As someone has mentioned always check your eula if unsure or if in doubt with legal jargon just contact the seller and they will be happy you asked for clarification.


My understanding is similar for rendo products but check with individual sellers.

PS. Although most sellers probably don't mind their products being used for adult products I believe that part of US and other countries copyright law allows a seller to expect that their product will be used in a way they deem appropriate. So a seller is entitled to object to the use of a product in adult work [or work in which they see is against their values or denigrates the quality of their work].

I have used a few sets and props to create what will become a comic book. There is no way to reverse engineer the textures from that and there will be no interactive or animated parts, so I think I'm in the clear. To be safe, I will be contacting the creators of some of the sex props to make sure it is okay and I will be crediting them in the notes. I'm sure that ....before Renderotic allows anything to be sold, they run it past their legal to. Thank you for replying!
