Hello,


Most of this has already been answered to me by Daz3D Forums, etc, but
I wanted to get it straight from the horse's mouth.


I am making a game using Daz3D Characters. I know I need an interactive license
for any 3D Models I use in my game, but I wanted clarification about two things first.


1: Do I own the copyright to any renders produced in Daz3D using Renderotica poses
and/or characters, clothes, resources, etc.


My common understanding is that yes, I do own the copyright to the renders, although it
can be difficult to prove in a dispute.


2: Assuming I own the rights to the Renders, can I use the renders in my game?
No moving characters or anything, just still images, either displayed on screen
or maybe on a billboard.


From what I've read on the Daz3D forums, yes I can use my renders in my game
without an interactive license, because they're just still images, but I wanted to confirm
it here at Renderotica.


Some of the Gens on this site seemed to come with some pretty powerful copyright protections,
ie: I own the copyright to all derivative works produced with my gens.


Not really an issue because I'm using golden palace with the extended license, but I wanted to make
sure there aren't clauses like that in the poses, related to Renders specifically.

To answer your questions, it can seem complicated but I'll keep it as simple as possible. When you purchase a 3D product to create renders, it comes with a single user license that gives you the right to use it for the creation of "flat" images.  An example of this is we have some artists who purchase products, poses, characters, etc and render them into comics that they can then resell here, or anywhere else they choose.  They own the rights to their comics even though they used a product to create them.  However, if you intend to use them in a game, it gets complicated. If it's an interactive asset, then it would require the "Extended" license version of the product to be purchased. These licenses are specific to the product, so be sure to read each license agreement before purchasing and downloading anything. As for using flat images in a game, that falls into a gray area, as you have license to create flat images for commercial use, but in a video game, if what you are using is an object like a table that can be walked around, even though it doesn't move or change shape, the game has to manipulate the camera angle and then the raw 3D asset needs to be in the game which can be ripped...which is why the extended license is required. Creating an image to use in the game like a magazine cover or a picture on a wall would be okay as the image is flattened.  In the end, you're always best to overprotect yourself with copyright licensing and not leave yourself open to legal liability.
