Anything 100% fictional is legal under free speech laws - even stuff that most would find repugnant - Animals, kids, extreme mutilation, etc.  So create with a computer/draw unless it's direct copies of real exact people (a big no-no here) not illegal.


Now here the TOS go against what I mentioned but haven't seen anything noted on incest.  The limit elsewhere is credit processors and whims of whoever owns a site or not.  Japan has tons of incest porn of course and again what I mentioned, usually drawn.  Bringing the stuff to the USA they go "StepMother" - etc. implying from another family so no real incest but...  Funny with Japan since usually have to pixelate openings to the body (Penis head, Vagina, Anus) but all the stuff mentioned.  Well even "Tubgirl" has to obey those rules lest it be "indecent"...

Long and short I can't imagine an 'incest' fantasy being blocked here or getting you in real world legal trouble - IF done by poser/daz figures you just say are cousins, brother and sister, whatever...  Just don't use the face room and put real people's faces on them and then tell people that you did it...  That runs into a LOT of legal trouble and the Admins have good reason to not allow it, even > fictional kids, animals...

DO NOT!!!!.....absolutely do not ask for this sort of advice in a bloody forum. Pay the damn money and talk to a real, live, honest-to-goodness lawyer in your area. Listening to people in a forum is a perfect recipe for a jail term. Folks may be well meaning but they are usually wrong. I doubt that Sutut is a lawyer. If he/she/it is, then they'd know NOT to give out advice on an internet forum. They didn't even ask where you live. What you can get away with in one country will get you decades in a deep, dark jail in another with no legal recourse.

The moderator should have jumped on this one.

Seeking legal representation may be sound advise, especially if one lives in the UK and yes certain countries have more lenient laws than others dealing with the age of children in any given sexual publication.   Beasty sex is a No No in almost any country now.  


The smart thing for anyone to do when they align themselves to a website such as ours is to read the sites TOS, and sadly most do not till they get in trouble.  This site forbids Children PERIOD!  clothed or not, if it character looks 17 and under you will get a nasty note from the staff and i think any Mod who might jump in here will say the same. 


Read our TOS and the TOS for any site you align yourself with for any publication.  


The bane of all this is that no mater what you post or where you post, any publication is deemed to be pirated. and what if that publication with your name on it shows up somewhere where the laws are different, Are you subject to prosecution? 


Do your homework check the laws of your country and maybe if you were going to publish something  in hard copy or some e-publications site seek a lawyer or better yet get an agent that will do it for you.   But for a hobbiest??  just check the local laws and make sure you understand in full the websites TOS   as to incest.. any character posted here better look like a freshman in college than a senior in high school.

SanKapo, with specific regards to creating works involving incest, it completely depends on the laws of the country where it is posted. Seeking legal advice would be a wise decision.

It is incorrect to state that anything fictional is legal. For instance, anything involving child pornography is illegal in real life as it is in the rendering world. Having said that, other sites may be willing to allow the posting of such images and take the risk of legal action. However, Renderotica does not permit those images and they will be removed from the gallery, as well as a potential suspension for the artist.

In the past, any indications of incest in images have involved the presence of a minor. Therefore, these images were removed under the umbrella of violating the Posting Guideline regarding minors. As a result of this forum post, a separate and concise Posting Guideline has been created specifically regarding incest in order to provide clarity for all our members.

A dedicated Content Moderator was retained earlier this year to review the gallery, both current and historical. This encompasses ensuring that all material aligns with our Posting Guidelines, which includes removing images as necessary. As there are currently over 200,000 images to review, it is a time-consuming and slow process.

Seems Incest is now no-go on this site...?



Over some other TOS issues I dealt with recently I'd looked over them and not found anything indicating incest - and I assumed the obvious if it violates the "No Minors" issue.  It seems from the moderator's text they updated it recently... "To clarify"...? Perhaps I missed it coz "Incest" isn't anything I'm into?  Don't really care, not moral reasons, just 'Uh, whatever..."  I remember in RL the producer of "Adam and Eve" magazine got sued for refusing ads for such porn in his magazine...  Food play grosses me out, but I just don't buy/watch porn where they smear goop that was once food over each other, I don't think it should be banned and anyone into it is a sickening monster...  Just ain't mah thang.


But I seem to have misinformed so let me correct.


 


And to the post by Brookes no I'm not a lawyer - I meant the Internet as largely hosted in the world - USA, Japan, Eastern European sites...  I don't know if wherever you live it's illegal for whatever...didn't think that was in the discussion.


The USA - and this has been brought up in court, fictional depictions are fictional.  Kids. Animals. etc.  No-go Renderotica of course but plenty of artists elsewhere create and even sell such content.  And it's been brought up to the supreme court.  USA and Japanese systems.  A few lower level convictions by agenda driven prosecutors but overturned by free speech defenders funded appeal.  There are 'alarmists' aka "Social Justice Warriors" that like to hit the complaint/flag button like a rat in a skinner box needing its next hit of cocaine -  and one of their tactics is to claim things are illegal and they are 'warning' people sometimes pretending to be LEOs.  Nope - if it was illegal they'd go straight to the law, no warnings.  And the law would get a warrant and kick down the door for "Justice by Points" no warning.


Also note a TOS doesn't protect a website from lawyers.


PayPal stands to lose many millions of dollars even if they get a victory because they've been letting said Moralists hit the complaint button too many times... Moralists or pure trolls wanting to ruin someone else's day - while at the same time advertising itself as a place the artist needs not fear a censor.  Same with being sued - either in trying to prevent people from doing something that might be grounds for a lawsuit (aka "Fair use/parody/tribute" which thanks to Mad Magazine is pretty established) or oppressing based on bias (such as left vs right) and relying on TOS to back it up as a free for all shield.  Just it's usually not worth the time/$ to sue - till they really piss someone off.  Also it creates competition if a business limits itself for a non-profit related reason.

Regardless of what anyone thinks they have witnessed in the court systems, the fact of the matter is that just like child pornography, incest is illegal, period. Renderotica, as a business, is not interested in fighting the legal battles of the artists who wish to post material depicting this genre and have recently added this to our Community Policies.  For anyone who wishes to create and post this type of material, there may be other sites that will allow it, or they can create their own site and take the chance that they aren't prosecuted. Renderotica will remove or simply change Titles or Descriptions of images that make reference to incestuous relations. This site has always been about supporting the artistic community and providing a place for original works to be posted.  We reserve the right to determine what legal liability we are willing to open ourselves up to and will make changes from time to time to the TOS and Community Policies.
